Governance Crisis Deepens at The Nairobi Hospital Amid Alleged Defiance of Court Orders

A deepening governance crisis has engulfed The Nairobi Hospital, with doctors and members of the Kenya Hospital Association raising alarm over what they describe as open defiance of binding High Court orders, institutional instability, and escalating financial distress at the premier medical facility.
In a press statement issued Monday, February 16, 2026, the Admitting Staff Association (Doctors) warned that continued disregard of judicial directives threatens constitutional order, fiduciary accountability, and the integrity of one of Kenya’s most pr

ominent healthcare institutions.
Court Orders Allegedly Ignored
According to the association, the High Court of Kenya issued multiple conservatory orders in 2025 restraining the hospital’s Board of Management from convening meetings and undertaking governance actions. The court reaffirmed in December 2025 that these orders remain binding and must be obeyed.


Despite this, the hospital’s Company Secretary, Gilbert Nyamweya — a named defendant — is accused of continuing to act in defiance of the orders.
Leadership Dispute and Mandatory Leave Standoff
The crisis intensified after Dr. Barcley Onyambu was removed as Board Chair in June 2025 but allegedly refused to vacate office. In July 2025, the Board placed Company Secretary Nyamweya and CEO Felix Osano on mandatory leave. Both are said to have ignored the directive and continued exercising authority, raising questions about enforcement and institutional oversight.
Concerns Over Board Co-options and State House Links
Doctors also expressed concern over the recent co-option of individuals allegedly linked to State House Kenya into the Board while court orders restraining governance changes remain in force. They warn that potential conflicts of interest may compromise procurement processes, insurance relationships, and financial management.
The group called for clarity from the Executive on whether it is aware of or endorses the contested appointments.
Financial Strain and Procurement Questions
The hospital reportedly recorded losses exceeding KSh 3 billion in 2024 and owes suppliers more than KSh 4 billion, leading to drug shortages and patient complaints over substandard medicines.
Doctors claim aggressive capital projects are being prioritized over core clinical services, raising concerns about inflated procurement costs, including hospital management systems and PET scan equipment. The facility is also reportedly seeking loans exceeding KSh 5 billion despite questions about its financial sustainability.
Allegations of Judicial Process Manipulation
The statement further alleges irregular transfers of cases, delays in listing contempt proceedings, and administrative manoeuvres that create perceptions of forum shopping and interference with judicial processes.
The doctors questioned why contempt proceedings have not been urgently heard despite alleged ongoing defiance of court orders.
Calls for Immediate Action
The association is demanding:
Immediate compliance with mandatory leave directives by the CEO and Company Secretary
Full obedience to subsisting court orders by the Board
Urgent hearing of contempt proceedings by the Judiciary
Executive clarification on governance concerns
Regulatory scrutiny of procurement practices and conflicts of interest
They warned that failure to address the crisis urgently could force further lawful action to safeguard the authority of the courts and the institution.
“The Nairobi Hospital belongs to its members, patients, and the people of Kenya — not factions or shielded individuals,” the statement said, emphasizing that the rule of law must prevail.
